ORBIT Terms of Service — draft
Staging draft. Provider details and public-launch requirements remain incomplete.
1. Draft status and provider
Staging draft, not approved for public launch. The version date is not permission to launch. Provider details, legal review and provider contracts must be completed before public availability.
Provider: [OWNER TO SUPPLY: legal name and legal form]. Registered office or legally required residential/business address: [OWNER TO SUPPLY]. Registration details and tax number, if applicable: [OWNER TO SUPPLY OR CONFIRM NOT APPLICABLE]. Support, complaints and content notices: [OWNER TO SUPPLY: working email and contact details].
2. Service and definitions
ORBIT helps you organise personal goals, progress and financial information. An account is the space linked to your verified email. Profit stores financial entries and imports. Vault stores items, images, categories and Fund records. Progress presents goal data and progress. Integrations are optional connections to external sources.
Social features let you search profiles, connect with friends and share selected lists, images, showcases and goal previews. Visibility depends on your settings and the type of content. ORBIT does not transfer money, hold funds or provide investment advice.
3. Account, age and contract formation
The initial public version is for people aged 18 or over. This is an ORBIT product policy, not a claim that GDPR universally requires users to be 18.
Registration requires an email address, access to the verification code or link, acceptance of the current required Terms and confirmation of age. A provisional authentication account used to verify identity does not complete registration. The ORBIT service contract is formed after identity verification and recorded acceptance of the Terms.
Privacy information is available before you provide your email. It does not require separate consent or acceptance. Health data consent, HealthKit permission and access to Google are separate decisions.
4. Technical requirements and security
The web service requires an up-to-date browser, JavaScript, internet access and storage needed for a session. Browser privacy settings may affect login or saved preferences. Apple Health requires a compatible Apple device, the native ORBIT app and HealthKit availability.
Protect your email account, device and login codes. Do not share your session. Report suspected account compromise through the stated contact. Do not bypass access controls, attempt to read others' private data or disrupt the service.
5. Data, calculations and limitations
Check your entries and imports. Summaries depend on source data, dates, time zone and goal settings. Incorrect or incomplete sources can produce incorrect results. ORBIT organises information and does not replace accounting, professional financial advice or legally required records.
ORBIT is not a medical service. Step counts, distance and progress are not intended for diagnosis, treatment or urgent health decisions. Consult a qualified professional about health concerns.
6. Integrations
Apple Health is optional. Before requesting HealthKit permission, ORBIT provides separate information and requests explicit consent to process steps and walking/running distance. History and withdrawal are described in the Health and privacy information.
The current Google Sheets import uses ORBIT's service account with read-only access to the entire shared workbook, not only the chosen tab or Profit cells. Inspection fetches metadata and the used cells of up to 20 worksheets to locate the verification marker and Profit table. Subsequent sync reads the entire used contents of the selected worksheet. We store daily Profit totals and selected metadata and links, rather than a complete workbook copy. Do not share a file containing unnecessary data. This is not end-user Google OAuth sign-in; ORBIT does not store your Google password or a personal OAuth refresh token.
Disconnecting a spreadsheet in ORBIT stops imports but does not remove Google's sharing permission. Also remove the service account from the spreadsheet in Google. Previously imported Profit entries remain your data until you delete them. Integration availability also depends on external providers.
7. Your content and sharing
You keep your rights to your content. You authorise the provider only to store, process and display it according to your visibility settings and provide requested exports. This does not transfer ownership or permit advertising using your health data.
Submit only content you have the rights and lawful grounds to provide. Do not submit unlawful content, material infringing others' rights, another person's private records, threats, scams or access credentials. Do not present someone else's data as your own.
Profiles and identifiers can be searched by signed-in users. An 'everyone' wishlist is available to other signed-in people; 'friends' restricts it to accepted friends. Selected goal previews and showcases may reveal personal information. Changing visibility does not erase copies already lawfully saved by others or their own entries.
8. Content notices and moderation
Anyone, including a person without an account, can report suspected unlawful content through the public notice channel linked beside these Terms. Identify the exact content, explain why it is unlawful, provide contact details when required and state that you act in good faith. Certain child exploitation notices do not require identification where the law provides an exception.
A person reviews notices with regard to context, users' rights and applicable law. Outcomes can include no restriction, restriction or removal of specific content, or proportionate account suspension. Where contact details are available, we acknowledge notices and communicate decisions; affected users receive reasons and available redress, subject to legal exceptions.
You may request reconsideration through the complaints contact. This does not restrict court remedies or rights under the Digital Services Act. Before public launch, the provider must establish a genuinely staffed channel and procedure.
9. Intellectual property
The software, ORBIT identity and provider materials are protected by law. You may use them as needed for ordinary use of the service. This grants no rights to another person's content or to impersonate the provider. Rights granted by mandatory law remain unaffected.
10. Availability, changes and charges
The provider maintains the service with due care. Maintenance, incidents and provider outages can temporarily affect access. Where possible, we inform you of significant planned interruptions. Use export to keep your own copy of your information.
This draft does not establish payments, subscriptions or automatic renewal. Future charges require advance information, appropriate terms and user decisions required by law; acceptance of these Terms alone does not authorise them.
11. Suspension and ending the service
Access may be restricted where required by law, security needs or a material breach of the Terms. Restrictions must be necessary and proportionate. Where law and security permit, we explain the reason, scope, duration and how to challenge the decision.
You may stop using ORBIT and delete your account in Settings after confirming your identity. You can export first. Deletion stops integrations and removes owned account data and files. The current implementation also deletes user-linked acceptance and consent evidence; no archive after account deletion has been established. Privacy information explains details and backup/log limitations.
If the whole service closes, the provider will give reasonable advance information and an export opportunity unless law or urgent circumstances prevent it.
12. Complaints
Send complaints to the stated contact. Describe the problem, approximate time, desired resolution and a reply address. Do not send login codes or unnecessary health information. Missing detail does not remove consumer rights; we may request information needed to investigate.
We acknowledge complaints and respond without undue delay within applicable deadlines, including 14 days where article 7a of the Polish Consumer Rights Act applies. You may seek assistance from a consumer ombudsman, competent authorities, available out-of-court procedures or a court. Arbitration is not compulsory.
13. Liability and consumer rights
The provider's liability follows applicable law. These Terms do not exclude liability that cannot lawfully be excluded or applicable consumer remedies for a digital service's lack of conformity. They do not transfer the provider's data protection or security duties to you.
External providers are responsible for their own services under applicable law and their terms. Using a provider does not remove ORBIT's own duties. Complaints and claims are assessed according to their circumstances and the law.
14. Changes to these Terms
Changes may be needed because of law, security, providers or actual service features. Material changes are explained in advance with time to review and decide whether to continue, unless law or urgent security needs justify a different deadline. The notice explains the reason, date and impact on your account.
A material version requiring acceptance is presented once before further ORBIT access. You may choose export or deletion if you do not accept. Typographical or editorial corrections alone do not force reacceptance. Updating privacy information alone does not create consent. Previous Terms remain available to download and recover.
15. Law and language
Polish law governs these Terms, while mandatory protections remain available, including applicable consumer protections of your country of habitual residence. Court jurisdiction follows law; consumers are not required to use only the provider's local court.
Polish is the canonical version for Poland-facing users; English helps you understand the document. Translation differences do not restrict statutory rights. Keep the version and date; archived versions form part of the history of your terms.
